On May 24, 2021, The Department of Homeland Security (DHS) released a Federal Register Notice (FRN) that designates Myanmar/Burma for Temporary Protected Status (TPS) for 18 months, effective between May 25, 2021, and November 25, 2022. DHS Secretary Alejandro Mayorkas previously announced the designation on March 12.
Myanmar/Burmese nationals (or those who had been habitually living in the country) who have been continually residing in the United States since March 11, 2021, and continuously physically present in the U.S. since May 25, 2021, are eligible to file initial applications to obtain TPS. According to the DHS, an estimated 1,600 Burmese nationals qualify for this designation.
If you are a Burmese national who is eligible for TPS, you have from May 25, 2021, through November 22, 2021—which is 180 days—to submit an initial Form I-821 (Application for Temporary Protected Status). You may also apply for TPS-related Employment Authorization Documents (EADs) and for travel authorization. The FRN details all the necessary procedures to apply for TPS and obtain work and travel authorization.
Myanmar/Burma was given TPS status due to a military coup that overthrew the democratically elected government on February 1, 2021. Protests and demonstrations led by citizens were met with violence and deadly force.
The coup has resulted in a humanitarian crisis, which includes restricted access to medical care and disrupted communications. Christina Schraner Burgener, the United Nations Special Envoy for Burma, warned on March 3 that the volatile situation in Myanmar could lead to warfare and world leaders must use all resources to resolve the crisis.
