Por ejemplo: <\/p>\n<ul>\n<li aria-level=\"1\">Los visados de no inmigrante con fecha de caducidad fija (como los visados de turista o de trabajo) comienzan despu\u00e9s de la fecha de caducidad que figura en tu I-94;<\/li>\n<li aria-level=\"1\">Los visados de estudiante o de visitante de intercambio comienzan cuando el USCIS, un juez de inmigraci\u00f3n o la Junta de Apelaciones de Inmigraci\u00f3n dictamina formalmente que has violado tu estatus (no simplemente cuando dejas de cumplir los requisitos del programa).<\/li>\n<li aria-level=\"1\">Entr\u00f3 sin inspecci\u00f3n (indocumentado), empieza enseguida.<\/li>\n<\/ul>\n<h3>Consecuencias de la presencia ilegal<\/h3>\n<p>Si acumulas entre 180 d\u00edas y un a\u00f1o de presencia ilegal, pueden prohibirte volver a EE.UU. durante tres a\u00f1os. Si acumulas un a\u00f1o o m\u00e1s, se te puede prohibir durante diez a\u00f1os. Puedes solicitar una exenci\u00f3n de la prohibici\u00f3n en determinadas circunstancias.  <\/p>\n<h3>Interrumpir la presencia ilegal<\/h3>\n<p>Aunque la presencia ilegal suele ser implacable, ciertos acontecimientos pueden detener o interrumpir la acumulaci\u00f3n de presencia ilegal, como por ejemplo<\/p>\n<ul>\n<li aria-level=\"1\">Presentar una solicitud <a href=\"https:\/\/www.rosinalaw.com\/es\/ultimas-noticias\/como-solicitar-la-adaptacion-de-estatus\/\">de ajuste de estatus<\/a>,<\/li>\n<li aria-level=\"1\">Solicitudes de asilo pendientes,<\/li>\n<li aria-level=\"1\">Mociones o recursos contra decisiones de inmigraci\u00f3n, y<\/li>\n<li aria-level=\"1\">Periodos de baja voluntaria.<\/li>\n<\/ul>\n<p>Salir de EE.UU. interrumpe el reloj de la presencia ilegal, pero no borra el tiempo ya acumulado. Por ejemplo, si acumulas 120 d\u00edas de presencia ilegal y luego te vas, volver\u00e1s a empezar desde el primer d\u00eda, no desde el 121, si regresas.  Sin embargo, el tiempo acumulado antes de irte permanece en tu expediente. Por ejemplo, si te das de baja voluntariamente despu\u00e9s de m\u00e1s de 180 d\u00edas pero menos de un a\u00f1o, se sigue aplicando el plazo de prescripci\u00f3n de tres a\u00f1os. <\/p>\n<h2>Estar fuera de estatus frente a la presencia ilegal<\/h2>\n<p>Aunque est\u00e1n relacionados, los conceptos de presencia ilegal y fuera de estado cumplen funciones distintas en la ley de inmigraci\u00f3n estadounidense. La presencia ilegal es el tiempo que acumulas mientras vives en EE.UU. sin estatus legal. Los indocumentados pueden acumular presencia ilegal aunque nunca hayan tenido estatuto. Acumular demasiada presencia ilegal te expone a posibles prohibiciones de regresar a EE.UU. Cada caso depende de hechos concretos, y no siempre est\u00e1 claro cu\u00e1ndo comienza la presencia ilegal.   Estar fuera de estatus significa que actualmente no tienes un estatus de inmigraci\u00f3n v\u00e1lido. Normalmente eres deportable si est\u00e1s presente en EE.UU. sin un estatus legal. Por tanto, si te quedas sin estatus, puedes ser expulsado.
