Attorney Stambaugh Interviewed About PA’s Backlogged Immigration Cases

On December 22, 2018, President Trump initiated a partial government shutdown after Democratic lawmakers refused to fund his $5.7 billion border wall. This shutdown – which is the longest recorded government shutdown in American history – is affecting immigration courts across the country and producing a hefty backlog of cases. According to Fox 43 News, hundreds of non-detainee cases have been pushed back by months and even years.

Campaign Promises vs. the American Dream

President Trump has always been very vocal and upfront about his stance on immigration. During his election campaign, he raised both cheers and eyebrows when he misleadingly claimed that Mexico would “be happy” to pay for a U.S. Mexico border wall. However, despite political resistance and a 34% public approval rating, President Trump still hasn’t given up on fulfilling his original campaign promise.

On January 19, 2019, President Trump addressed the nation and announced that he was willing to support extensions of the DACA and TPS programs in return for his border wall. When Democrats declined this overture, the White House prepared a draft proclamation for President Trump to declare a national emergency along the southern border. While American citizens wait with baited breaths for the outcome of this political showdown, countless migrants are still waiting for their immigration hearings.

Fox 43 News consulted our very own immigration attorney, Rosina C. Stambuagh, Esq., about how this political impasse isn’t helping hopeful migrants. She explains, “The non-detained courts aren’t running. Those are the people that have already been waiting two to three years for that hearing. Individuals who have had what we call their final hearing day in court where the judge would make a final decision on their application, the judges aren’t ruling on them. Those that maybe don’t have a strong case are actually benefiting from their case are getting to stay here longer. I just hope that we can actually work together and come up with a resolution on the actual issues that are needed.”

During this public address, President Trump addressed the government’s plan for managing the case backlog: “Seventy-five new immigration judge teams to reduce the court backlog of believe it or not, of almost 900,000 cases. The whole concept of having lengthy trials for anyone that sets on foot in our country unlawfully must be changed by Congress.”
